The existential threat posed by climate change is undoubtedly one of the most serious challenges facing humankind today and one of the most urgent human rights crises to which the international community is paying close attention,this is particularly true for vulnerable groups and some island states.To address the challenges posed by climate change,the international community has worked together to integrate human rights principles into climate change negotiations,with the United Nations Framework Convention on Climate Change,Kyoto Protocol and Paris Agreement as the main legal carrier,a set of cooperation and binding mechanism has been constructed.The advantage of a human rights based approach is that it can use the existing international human rights law framework to hold governments accountable for their failure to address climate change.However,the effectiveness of such an approach depends to a large extent on how states ‘obligations under human rights law are defined in the particular context of climate change,and the ability to determine that human rights violations have occurred in the country.The climate-change talks have been entwined with too much political jockeying,resulting in a disregard for the positive calls for "climate justice" from more developing countries or groups.Therefore,the implementation of human rights protection in the context of climate change,or more hope for practical action within the country.States should recognize the procedural obligations under the International Human Rights Law relating to environmental protection,such as guaranteeing people's rights to access information,public participation and access to effective remedies.At the same time,states should enact and enforce corresponding domestic laws and fulfil their substantive obligations to prevent transboundary environmental damage.The study of international human rights protection under climate change is of great practical significance to China in: At the domestic level,efforts are made to resolve the contradiction between economic development and climate change governance,and to achieve a balance between the right to development and the right to the environment;at the international level,china will continue to uphold the principles of common but differentiated responsibilities and sustainable development in human rights governance,and respect,protect and fulfil human rights while establishing a say in global climate governance.
