At present,"the world is facing a big change that hasn't happened in a century," crisis and opportunities coexist during the change.Big data and related technologies around the world are in a period of accelerated development and continue to penetrate into the practice of economic activities and social governance,promote the development of the commercial market to a new height.But at the same time there are many problems in the fields of competition and monopoly about the new technology.In recent years,with the development of the domestic economy and the expansion of the market,China 's data volume has continued to increase,data industrialization capabilities have continued to increase.China's big data industry has maintained a positive trend of development,data has driven the continuous development of business form.The big data market has from the new format of economic development to the new normal,the digital economy with the big data market as a macro-type has become the main driving force and new growth point for China's economic development.However,the continuous development of the new economic format will inevitably cause the deficiencies of traditional legal regulations.Especially the lack of legislation and unclear enforcement of competition laws,which will cause many monopoly concerns and risks.Based on this,this article studies along the main line of competition law regulation in the big data market,analyzes the development status of the big data market and the corresponding competition law regulation status from four aspects.Then this article find out the shortcomings and proposes corresponding improvement strategies of improvement.It is mainly aimed at the problem of backward competition legislation and ideas,and puts forward a new concept of tolerance and prudence to monitor competition in the big data market.Aimed at the deficiencies of the relevant market in the traditional anti-monopoly law,putting forward perfect measures and new methods.Aimed at the problem that the elements of the evaluation competition in the traditional antitrust law lag behind the development of the big data market,an innovative evaluation element is proposed to improve the level of law enforcement by antitrust enforcers in the big data market environment.Finally,it proposes relevant legislative improvement strategies for the "public power" problem caused by the deep participation of the big data market in social governance.By sorting and analyzing the basic theoretical issues related to the big data market and competition laws and regulations,the evolution of the big data market and the current status of development and explained.Combating the application logic and practice of China's competition law and the status quo of foreign countries on the big data market.Analyzing the problems and dilemmas of the current competition regulation in big data market.Pointing out the new challenges of competition law enforcement in the big data market,and proposing corresponding strategies for improvement.It is hoped to draw up a competition law regulation system that is in line with the development status of China's big data market and has a certain prospect,a benign interaction situation of effective competition supervision and industrial innovation will be formed,and a governance idea that emphasizes both development and security will be achieved.All of these will provide valuable reference for the improvement of competition law.
