Research On The Legal System Of Anti-corruption International Cooperation In The Context Of "One Belt One Road"

The Belt and Road Initiative is an open and inclusive economic cooperation initiative raised by China in 2013.It is exposed to a high risk of corruption in the connectivity of infrastructure,unimpeded trade and financial integration.Therefore,it is necessary to strengthen international cooperation against corruption to build a clean road.International cooperation against corruption dates back to the 1970 s.And at present the cooperation system consists of three levels,including global cooperation,regional cooperation and bilateral cooperation.The United Nations Convention against Corruption is the first comprehensive global convention against corruption.In order to improve international cooperation against corruption under the context of the Belt and Road,China should play an active role in advocating the adoption of the Belt and Road Convention against Corruption and the Foreign Corrupt Practices Act on the basis of the existing legal system of international cooperation against corruption.At the same time,the improvement of specific anti-corruption measures is also needed.First,it is a good idea to introduce a human rights-based approach t in the anti-corruption cooperation as the supplement to the traditional methods,which focuses on the application of the existing international human rights standards and mechanisms to combat corruption and on the protection of the human rights of the accused and anticorruption participants.Second,it is also crucial to encourage citizens,enterprises and NGOs to participate in the anti-corruption cooperation efforts along the Belt and Road.Finally,effective measures should be taken to promote the independence,specialization and expertise of anti-corruption agencies,to provide them with adequate resources and staff,and to strengthen cooperation among them by adopting the China-Laos Railway Model.
