Research On Litigation Documents In Wendou Village, Guizhou

Wendou village is under the jurisdiction of Jinping County,which is located in the middle and lower reaches of Qingshui River in Jinping County.Its geographical advantages make Wendou grow rich in wood.People in Wendou village always have the habit of planting trees.They will plant a tree at birth and death to show the continuity of life,which shows the importance of trees in this area.It can be seen from a large number of existing steles that the wood production of Wendou village in Ming and Qing Dynasties is rich and its quality is good,thus attracting a large number of timber merchants to enter the Wendou village for timber trading.Because of the frequent timber trade,the local economy is developed,and the legal documents in the Wendou area are booming.In this paper,218 legal documents are collected.Among them,there are 105 CI documents,16 family documents,34 official documents and other folk documents,32 mediation documents and 31 inscriptions documents.Among them,these documents are only a part of the documents in Wendou area,and a large number of original documents are scattered in the countryside.This paper mainly discusses the documents collected by Yi zunfa and Jiang Qicheng,two families in Wendou village of Jinping area,to carry out the research,collation and analysis of the documents of CI form and mediation.This paper takes the original document as the basis of analysis.First of all,the paper abstracts the litigation strategies of Wendou village documents,including exaggerating the grievance,using moral discourse to sue the grievance and emotional discourse to sue the grievance.Then it discusses the different ways of breaking the dispute settlement in Wendou village,including the ways of the government,the gentry,self reconciliation and the gods breaking.Finally,it discusses the role of the people in Wendou village,including the persuasion,social security and the role of the people in writing.There will be forms in the text,which mainly play an argument role.The elements of forms include the name of the document,the parties,the mainreasons and so on.We want to show the characteristics of the documents in Jinping’s Wendou stronghold.Through the analysis of word form and mediation documents,we can see that the degree of Sinicization of wendouzhai documents is very high.But there are also unique ways to resolve disputes in villages.Among them,such as the resolution of disputes as breaking the chicken’s head and uniting the gods.This paper initially shows the way of dealing with the disputes of the Wendou people,at the same time,it also wants to attract more researchers to participate in the study of the Wendou village documents,and make an effort for the documents in the Wendou area.
