Research On Contract Dispute Resolution Mechanism Of PPP Projects In My Country

In recent years,with the guidance of national policies and the encouragement and support of the government,China's PPP project has been carried out in full swing,involving more and more fields."PPP" is a foreign product that has gradually taken root in China and made great achievements.It is true that the PPP model,as a mechanism designed by the government to realize the public interest of society,has played a huge role in providing public goods and services to the public.However,with the blowout development of PPP project,the problems in the development process of PPP model cannot be underestimated.There are many disputes between the government and the social capital in signing and performing the PPP project contract.However,due to a series of problems in the dispute resolution mechanism in China,the disputes cannot be effectively resolved,which hinders the standardized development of PPP project.This paper focuses on this practical dilemma,first introduces the relevant concepts of dispute resolution mechanism,then points out the existing legal problems by analyzing the current situation,and then puts forward the corresponding legal countermeasures by referring to the advanced experience of other countries and combining with the actual situation of our country.In addition to the introduction and conclusion,this paper is divided into four chapters.The first chapter is the theory of PPP project contract,from the definition and classification of PPP model,the origin and development of PPP model,to the concept,participants,characteristics and legal attributes of PPP project contract,and finally introduces the connotation and basic content of the dispute resolution mechanism.The second chapter mainly expounds the current situation and legal issues of the PPP project contract dispute resolution mechanism,and points out a series of problems existing in the current PPP project contract dispute resolution mechanism through the analysis of the current situation.The third chapter is the introduction of the experience of the countries thathave successfully applied PPP mode,mainly the introduction of the contract dispute settlement mechanism of PPP projects in three typical countries,Britain,France and South Korea.The fourth chapter is the countermeasures and suggestions of the PPP project contract dispute resolution.Through the second chapter of the status and problems of the elaboration and the fourth chapter of foreign experience,it puts forward the relevant suggestions to improve the PPP project contract dispute resolution mechanism in China.
