The rapid development of the Internet has brought tremendous changes to social life,and has also promoted the vigorous development of the digital music industry.In our country,digital music has experienced an era of brutal development and rampant piracy.Since the National Copyright Administration issued the "Notice on Ordering Online Music Service Providers to Stop Unauthorized Dissemination of Music Works" in 2015,the legalization of digital music in China has been steadily advancing and has become the main driving force for the development of the digital music market They are also competing for digital music copyrights.The exclusive licensing model of digital music came into being.It provides digital music creators with an effective method of protecting intellectual achievements,and has become a powerful weapon for major digital music platforms to compete for the digital music market.Due to the risk of restricting competition due to its exclusive attributes,and the widespread use of the exclusive licensing model,a large number of digital music copyrights are concentrated in the head digital music platforms.Therefore,the anti-monopoly regulation of the exclusive licensing model of digital music has attracted the attention of the academic community.This article first describes the basic concepts of the digital music exclusive licensing model and the status of the digital music market,explaining the application of the digital music exclusive licensing model in the digital music market competition;secondly,using the antitrust analysis framework,from the relevant market definition,market Anti-monopoly analysis of the exclusive licensing model of digital music in terms of dominant position determination,types of market dominant position abuse and the effects of abuse of market dominant position;finally,for the possible restrictions on competition risks caused by the exclusive licensing model of digital music,preventive measures are proposed: Firstly,consider the characteristics of the Internet market different from the traditional market,and improve the method of defining the relevant market;secondly,draw on the "U.S.Copyright Law" to limit the time and quantity of China's exclusive licensing model of digital music;thirdly,to protect the interests of consumers,promote the mutual authorization of digital music platforms,weaken the risk of malicious copyright competition on the premise of protecting the copyright of digital music;Finally,use technical means to protect digital music copyright and to promote the sound and orderly development of the digital music market.
