Research On The Regulatory Path Of Exclusive Licensing Model Of Digital Music

The advent of digital music copyright not only affects the way the public access to music products,but also affects the business decisions of digital music operators.In order to obtain more music copyright,various licensing modes have been applied to the digital music industry,including the exclusive licensing mode of digital music.The extensive application of the exclusive licensing mode of digital music may lead to the vicious bidding of digital music copyright,and the operators who fail to sign the exclusive licensing agreement may find it difficult to fully compete due to the lack of music copyright,and the consumers’ right to choose may also be deprived.Based on the above facts,the application of exclusive license mode of digital music has attracted a wide range of attention.Therefore,it is necessary to probe into the competitive effect of exclusive licensing mode of digital music and explore its regulatory path.This paper will start from Tencent music’s exclusive licensing behaviors,combined with the competition situation of digital music related market,and study the competition problems that may be caused by the exclusive licensing model of digital music.This paper holds that if the difficulty of market entry,conspiracy in related markets and the damage caused by non-price monopoly can be evaluated and identified,the anti-monopoly law can be applied to the regulation of the exclusive licensing model of digital music.At the same time,considering that the development of China’s digital music industry is still in its infancy,from the perspective of balance of interests,the exclusive licensing model of digital music has its own value.However,in order to prevent the competition risk caused by the exclusive licensing model of digital music,it is recommended to introduce the supervision of copyright law and the digital music industry as a supplement to the anti-monopoly regulation.
