Research On The Expert Demonstration System For Major Administrative Decision-making

The promulgation of the Interim Regulation on Major Administrative Decision-Making Procedures set the expert demonstration system as a statutory procedure,and stipulated that the government should establish an expert database for decision-making consultation and demonstration and standardize the operation management system of expert institutions.Legislative status rise,structures,specialization,standardization of system platform,the experts with professional,neutral role involved in the major administrative decision-making,and promote the major administrative decision-making scientific and promote the development of the expert evaluation system,form a system of expert demonstration system in China,However,there are still many problems in practice.On the institutional basis,China's political foundation,economic foundation and citizens' sense of participation is poor which leads to the weak foundation of experts' status,independence and professionalism.First of all,in legislation,the Interim Regulation on Major Administrative Decision-Making Procedures on the participation of experts in the argumentation are rough and mostly principles,lack of stronger procedural provisions,lack of guiding significance.Secondly,in terms of the regime system,the experts of major administrative decision-making demonstrate that the legal and normative system is decentralized,and the normative methods and contents are quite different,resulting in regional and hierarchical conflicts.In the construction of expert database,there are some problems,such as scattered management,unsystematic management,unscientific management system,and unsound mechanism for the assessment of experts' integrity and exit.In the process of expert argumentation,the scope of expert argumentation is uncertain,the starting conditions are not clear,and the feedback mechanism of expert opinion is not established.Therefore,the paper based on the promulgation of the Interim Regulation on Major Administrative Decision-Making Procedures,analysis expert argumentation system still exist problems,put forward some legal suggestion,such as improved the organization construction of the argumentation of major administrative decision-making experts,build a library of argumentation of consulting experts,and train high-level experts.To improve the guarantee mechanism of argumentation of major administrative decision-making experts,guarantee the rights and obligations of experts,establish effective incentive mechanism and enhance the independence of experts;Establish a supervision mechanism integrating legal,departmental and social supervision,so as to promote the effective operation of expert argumentation system.
