Research On The Interactive Relationship Between Law Enforcement And Legislation And Its System Construction Under The Background Of Big Data

"If good laws are established in the world,the world will be governed;if good laws are established in a country,the country will be governed",with the intention of fulfilling the requirement put forward by the Fourth Plenary Session of the Eighteenth Central Committee to "form a complete system of legal norms,an efficient system for the implementation of the rule of law,a strict system for the supervision of the rule of law and a strong system for the protection of the rule of law",attention must be paid not only to the legislative aspect of "regulation" and the law enforcement aspect of "governance",but also to the healthy interaction between legislation and law enforcement.If legislation and law enforcement can effectively interact to form a virtuous interaction of the organic whole,it will be very helpful to promote accurate legislation and accurate law enforcement to go hand in hand and achieve accurate governance.In the era of big data,especially during the period when the government is vigorously promoting "Internet+" government affairs,the study of the interaction between law enforcement and legislation and its institutional construction undoubtedly has important theoretical and practical significance.In this paper,the starting point is to clarify the existing relationship between law enforcement and legislation,and use the different stages of legislation as the logic to summarize and sort out the interaction between the existing law enforcement and legislation,such as legislative research,legal interpretation,law enforcement inspection,and post-legislative evaluation,and try to explore the reasons for the inadequacy of the existing relationship from the three dimensions of legal democracy,legislative centrism and legal effectiveness.On this basis,the article introduces and explains theconcept and connotation of the interaction between law enforcement and legislation,and examines the content and characteristics of the interaction between law enforcement and legislation.The rapid development of big data technology provides the technical feasibility for substantive interaction and integration of the two disconnected links of executive enforcement and legislation.In the foreseeable future,administrative law enforcement agencies will greatly improve the efficiency of administrative law enforcement by relying on big data to carry out law enforcement work,and on the other hand,linking big data to law enforcement work in different regions so that the "sandbox" of law enforcement work can be extrapolated to the greatest extent,which will enable the effect of legislation to be "confirmed" by the greatest extent of data,and push lawmakers to observe and amend from a holistic perspective.Based on this,the paper analyzes the positive impact of big data on the construction of the interactive relationship between law enforcement and legislation,as well as the role and advantages of law enforcement and legislation in the context of big data,and attempts to construct an interactive system of executive law enforcement and legislation in the context of big data to promote the establishment of a "complete legal normative system" and an "efficient rule of law implementation system" around the three levels of the construction and operation mechanism of the big data platform,the interactive mechanism between legislation and law enforcement in the big data platform,and the guarantee mechanism between law enforcement and legislation in the big data platform,so as to realize the precision of governance.
