| The Fujian Free Trade Zone has the geographical and cultural advantage to Taiwan,and its functional positioning is Taiwan-based exchanges.Based on this positioning,it has token a number of convenient exchange measures between Taiwan to promote cross-strait trade,staffing and cultural exchanges.In Taiwan,Fujian has always been the popular choice for Taiwan's young people to start businesses and employment.The large scale of labor mobility and the differences in the social security systems of the two places have made the issue of labor rights protection across geographical regions prominent.This study focuses on the most distinctive work injury insurance system in labor insurance.The topic of this study is the work injury insurance system that has the closest relationship with labor rights,the subjects of this study are Taiwan laborers in the Fujian Free Trade Zone.We hope to learn about the similarities and differences in industrial Injury Insurances of the Fujian Free Zone and Taiwan,the barriers of the transfer and the convergence of injury insurance for Taiwan laborers in the free trade zone,etc.,and attempt to propose a model for constructing the insurance transfer system for workers in both places.This study uses literature analysis,comparative analysis,normative analysis,field investigation.By extensive reading of relevant literature in Taiwan and the mainland,this study analyses the regulations and policies in Fujian and Taiwan,and summarizes the similarities and differences in regulations of the two places in the industrial Injury Insurance system to explore the transfer basis.The field investigation method means that this study conducted in-depth investigations in Taiwan and Pingtan to understand the forms and concerns of Taiwan laborers coming to Fujian for employment.This study has initially found that most Taiwan laborers in the Fujian Free Trade Zone are not involved in Fujian Industrial Injury Insurance and are not sure whether the occupational disaster insurance in Taiwan is still insured.At the transfer level,the household registration system in the two places is the main reason to hinder the entry of Taiwan laborers into the Fujian Industrial Injury Insurance System;the lack of the transfer system is the direct cause of the inability of industrial insurance in the two places to transfer.The convergence involves the economic development level of the two places and the currency system,as well as the specific provisions of the Taiwan Occupational Disaster Insurance System and the Industrial Injury Insurance System of the Fujian Free Trade Zone,such as the scope of insurance coverage,labor certification standards,and insurance benefits.To sum up,the recommendations made in this study are:(1)establish the principle of coordination as a guide for the transition system,such as the principle of respect for and tolerance of differences,the principle of equality,and the principle of investigation of accidents at work accidents,etc.;(2)Establish an institution for specialized management of industrial injury insurance for Taiwan labors in the Fujian Free Trade Zone and set up a specialized dispute resolution processing platforms,which are jointly managed by Taiwan and the mainland.(3)Promoting exchange learning through the use of diversified forms,and using the Internet to create a platform for sharing information and learning materials;(4)Establish a mutual recognition mechanism for industrial injury insurance for Taiwan laborers in the Fujian Free Trade Zone,including the scope of insurance coverage,rate models,and occupational hazard identification standards,etc.;(5)Establishing a method to calculate the treatment of the industrial Injury Insurance for Taiwan Laborers in the Fujian Free Trade Zone,such as the establishment of the principle of convenient payment of the location of labor relations and the place of work,the method of calculating the salary of insurance coverage,and the unified issuance of insurance benefits,etc. |
