Labor dispatch has become an indispensable mode of employment in China since the 1980 s.When labor dispatch employee produces inductrial injury insurance,the responsibility between accepting unit and unit of choose and employ persons assumes a problem for a long time is the hotspot of labor law.Firstly,this paper explains the concept of labor dispatching and sorts out the current laws and regulations on labor dispatching,and summarizes and sorts out the existing problems in the application of labor dispatching laws.Next,by sorting out the labor dispatching industrial injury insurance dispute cases in the past five years,the types of appeal reasons are distinguished,and the relevant regulations in various places are further expounded.At present,the contradictions in the labor dispatching judgment are caused by the disputes over the definition of the legal relationship of labor dispatching in China,which can be divided into "single employer" mode and "joint employer" mode.This paper analyzes the advantages and disadvantages of each model and concludes that the co-employer model is more conducive to protecting the dispatched workers.Finally,the author puts forward some Suggestions on the design of the responsibility system of labor dispatching subject in China.
