Research On Contract Reference Point In Construction Project Based On Contractor's Fairness Perception: Data From Eye Movement Experiment

In construction project,employer often formulates strict contract clauses in the bidding stage of project to ensure the controllability of project investment and the realization of project performance.However,contract clauses that formulated based on the assumption of "economic man" ignore "social man" attribute of contractor.Strict contract clauses make contractor feel unfair,and indirectly lead to negative performance and opportunistic behavior of contractor,resulting in low performance finally.Contract reference point theory points out that construction contract is the sole criterion that judge the right of contractor,which affects the choice of performance.Therefore,the core point of project performance improvement is whether contractor feel his own rights and interests are treated fairly.According to contract reference point theory,in construction project,contract clause which related to the rights and interests between employer and contractor that can also be used as reference points,and will cause contractor's fairness perception.When contract sum matches the risk that contractor undertook,and contractor's rights are treated fairly in adjustment of contract sum,it may be considered that contract is fair.It can be seen that contract clauses related to contractor's rights and interests which formulated by employer and contractor are reference points to judge their own interests,and they will also induce contractor's fairness perception.In view of this,in order to determine contract reference points which can induce contractor's fairness perception,this paper intends to choose the method of eye movement experiment to explore the relationship between contractor's fairness perception and contract clauses related to the rights and interests.This paper mainly includes the following two parts:1.The design of eye movement experimental material.Based on the review and analysis of relevant research,in order to control the experimental process better,we select engineering change and price fluctuation as two experimental situation,representing the situation that has a large and small impact.Experimental material are contract clauses related to engineering change and price fluctuation.Firstly,refine contract clauses to make them readable.Secondly,in order to ensure the rationality of contract clauses,select 30 contractors or experts who engaged in contract management research to evaluate the rationality of contract clause,they do not participate in the formal experiment.Lastly,through the pre-experiment to improve and modify experimental materials,and then determine the final experimental material.2.Determination of contract reference points for construction project.Firstly,through eye movement experiment to collect contractors' eye movement indices that read experimental materials,such as fixation count,fixation duration,hot spots,and to analyze the attention of contract clauses,so as to acquire contract clauses which can catch contractor's attention.Secondly,after the end of eye movement experiment,each participant was asked to fill in the questionnaires and interview,so as to understand contractor's fairness perception to different experimental materials.Finally,compared with the existing research,verifying the relationship between contract reference points for construction project and contractor's fairness perception,and defining the composition and structure of contract reference points for contraction project.
