Land is the natural resource on which human beings depend for their survival.As times change,the land system of in China has changed dramatically since the founding of the people's Republic of China.Having endured the agricultural cooperative period of mutual aid group,primary society,senior community,people's commune,China explored the land system that meets the needs of the reality of national conditions;During household contract management after the reform and opening up the relevant system was established and improved.During the transition period from farming civilization to industrial civilization,problems such as "rural areas,farmers,agriculture" have emerged.Since 2003,the "No.1 document" of the CPC Central Committee has taken "three rural areas" as the main line for many years,which shows that "agriculture,countryside and farmers" play an important role in the development of the whole society and economy.The "No.1document" issued by the Central Committee in 2017 continues to deepen the reform of the rural collective property right system with the main line of the "three rural issues",and activate and stimulate the inherent development power of agriculture and rural areas.Rural collective economic organization should become an inseparable player in the reform of rural development.In recent years,the government has made great efforts to coordinate the development of urban and rural areas,eliminate the dual structure of urban and rural areas,and build a well-off society in an all-round way.Guangdong Province is located in the most southeast of China.According to Statistics Official of Guangdong province,in 2016 GDP in Guangdong reached 7 trillion and 950 billion RMB,with a growth rate of 7.5%,and the total GDP has ranked the top for twenty-eight years.The Pearl River Delta region in Guangdong Province has always been in the forefront of the province's economy,thus giving birth to a variety of economic cooperation organizations.We take Dongguan and South China Sea as the main research objects that are the representative of typical rural collective economic organizations.In the process of eliminating the dualization of urban and rural areas,the urban population has kept increasing;the urban modernization is accelerating,and the township enterprises are developing rapidly.Farmers' land is constantly expropriated or invested in the price,and the economic benefits of the land are highlighted day by day.In consequence,various disputes are followed,which involves land expropriation and compensation,transfer of contract rights and management rights,ownership of collective assets,members? welfare and qualification,and so on.These contradictions and disputes remain to be solved urgently.However,in the reality,the complex rural environment cannot meet the requirements of the status quo objectively and impartially with single identification standard.The membership of rural collective economic organizations is not only related to the distribution of land requisition compensation,but also concerns whether members can normally exercise the right to use rural homestead,the right to contract rural land,the right to operate,the right to enjoy the rights and interests of collective assets,the collective decision-making and voting on major matters.Therefore,the key to resolving disputes lies in the criteria for determining the qualifications of the members of rural collective economic organizations.Identifying the identification standard of their membership is a solid foundation for distribution of rural collective property with fairness and equity.It is also necessary to formulate reasonable and legal standards of identification in a comprehensive and objective manner.We should ensure that its members? rights are infringe,they can be able to adopt judicial remedies,applications for arbitration and other measures.After the member's benefits are damaged,we must take relevant relief measures in time to minimize the personnel loss.
