| Packaged tourism refers to a kind of tourism activity in which tourists and travel agencies sign a contract of package tourism and arrange food,accommodation,travel,travel,shopping,entertainment and other activities for tourists on the way according to the contract.Packaged tourism is one of the most common types of tourism activities.It is based on the establishment of a package tourism contract.In the process of fulfilling the contract,travel agencies bear the legal oobligation to guarantee the safety of tourists.Based on the category of contractual relationship of package tourism and from the perspective of liability for breach of contract,this paper chooses typical cases of tourism safety disputes in the contractual relationship of package tourism as an example to analyze,summarizes the principles of liability attribution and types of liability for breach of contract caused by this type of tourism safety incidents,and then takes the connotation of security obligation of travel agencies in the contractual relationship of package tourism as an example.From the point of departure,the contents,boundaries,the criteria for determining the liability for breach of contract,the sequence of liability assumed and the reasons for exemption of liability of the subject of security in the contract relationship are studied as a whole.On the basis of a thorough study of the security obligations of travel agencies,this paper puts forward some ideas and suggestions to improve the security management level of package tourism,including strict implementation and perfection of tourism legislation protection,rational use of commercial insurance,promotion of the safety awareness of tourism subjects,and promotion of the construction of emergency rescue mechanism for Tourism safety in China.The measures and countermeasures are expected to play a certain practical guiding significance for the benign development of package tourism activities and the improvement of the level of tourism security in China. |
