The Influence Of WTO Dispute Settlement Mechanism On The Development Of The U.S. Copyright Trade

The dispute settlement mechanism is an effective way for the World Trade Organization(WTO)to deal with trade disputes between member states,and it provides an international platform for resolving international trade frictions and safeguarding the legitimate rights and interests of its member states.This thesis focuses on the relationship between the WTO dispute settlement mechanism and the development of the U.S.copyright trade.Through the sorting out and summarization of all copyright trade dispute cases involving the United States since the establishment of the WTO,this thesis analyzes the impact of the dispute settlement mechanism on the U.S.copyright trade.First,this thesis discusses the basic concepts of the WTO dispute settlement mechanism and the copyright trade,and then analyzes the general situation of the U.S.copyright trade and its dispute cases under the WTO system.Through the combing of the U.S.copyright trade dispute cases,this thesis finds that among the 11 copyright trade disputes that the United States participated in,there are 10 cases in which the United States is the complainant,and only 1 case in which the United States is the respondent.Then,based on the role analysis of the United States in the WTO dispute settlement mechanism,this thesis further explores the impact of the dispute cases on the development of the U.S.copyright trade through the cost-benefit theory.And the thesis finds that as the winner of the disputes,the United States can break the trade protection barrier of the respondent country,force the respondent country to modify their laws and regulations,thus further promoting the exports of the U.S.copyright products and expanding the exports interests of the U.S.copyright industry.This thesis further confirms that the WTO dispute settlement mechanism is an effective way for the United States to open the Chinese cultural market and actively promote the development of its copyright trade through the case analysis of the dispute between the United States and China about Chinese measures affecting trading rights and distribution services for certain publications and audiovisual entertainment products.Through an analysis of how the United States utilizes the WTO dispute settlement mechanism to develop its copyright trade,it is beneficial for China,as a rival and a learner,to further understand the operation of the WTO dispute settlement mechanism,thereby enhancing China's future capability to deal with the copyright trade disputes.
