In 2018,with the slowdown of China's overall economic growth and the implementation of new rules on asset management,the pace of economic deleveraging and rigid payment cancellation is accelerated.China's P2 P industry has successively issued various regulatory policies to strengthen the supervision of the industry and regulate bad phenomena in the industry.Strong regulatory policy in the implementation of a P2 P industry,makes a lot of the problem of irregular operations platform have closed down,in June 2018 to August P2 P industry usher in thunder "in the boom in China,three months a total of 467 questions platform collapse,hundreds of billions of assets loss and millions of investors suffered varying degrees of economic losses,this brought an extremely bad influence to P2 P industry in our country,not only brought huge property losses to investors,a blow to investor's investment enthusiasm and confidence,and to the whole P2 P industry caused great negative impact,affecting the healthy development of the P2 P industry.Among the closed platforms in this boom,the most representative one is the Tang Xiaoseng platform.Starting from the case analysis of the collapse of the Tang Xiaoseng platform,this paper introduces the process from the establishment to the collapse of the Tang Xiaoseng platform in detail.After that,the paper analyzes the reasons for the collapse of the platform from the perspectives of the platform itself,investors and regulators.First of all,the internal cause is the illegal operation phenomenon of the Tang Xiaoseng platform: first,the platform exists self-guarantee phenomenon.Second,the platform conducts illegal fund-raising through false publicity.Third,information disclosure fraud.Fourth,the platform does not have depository Banks.External causes are blind investment by investors and the unsound regulatory system,among which the unsound regulatory system of China's P2 P industry is also the main reason for the collapse of the Tang Xiaoseng platform,which is mainly reflected in the lack of clarity of the industry regulatory authorities,the lack of industry regulatory laws and regulations and the lack of a unified industry self-discipline organization.Based on the case analysis of the collapse of the Tang Xiaoseng platform,this papersummarizes the problems in the supervision of the Tang Xiaoseng platform,which is also a common problem in the supervision of China's P2 P industry.First,P2 P has been in the state of lack of supervision for a long time in China,and the supervision institutions are not sound.Second,the industry legal norms are not perfect.Third,before the establishment of China Internet finance association,China's P2 P industry has not had a unified national self-discipline organization,resulting in weak self-discipline in the industry.So many regulatory problems need to be solved,and a sound industry regulatory system needs to be established.Therefore,this paper draws lessons from the supervision system of P2 P industry in the UK and the us from the three aspects of industry regulators,regulatory laws and regulations,and regulatory self-regulatory organizations,and improves the construction of industry regulators to strengthen consumer protection.Improve the legal norms of industry supervision;This paper puts forward relevant Suggestions on strengthening the construction of industry self-discipline and improving the construction of industry self-discipline organizations,hoping to play a constructive role in relevant regulatory authorities.
