The Study Of The Intellectual Property Rights Barrier Against China's High-end Manufacturing Industry And Its Countermeasures

After the implementation of Open and Reform Policy since from December 1978,especially after the People's Republic of China joined the World Trade Organization(WTO)in 2001,the manufacturing industry has developed very fast in China.Meanwhile,the Chinese government promulgated the “Made in China 2025” which aims to transfer from “Made in China” to “Created in China”.With the innovation mechanism being established as mentioned above,there are many high-end manufacturing industries as well as relevant high-end products surges in China.Meanwhile,the developed countries in Europe and America have lost their advantage in the field of traditional manufacturing,while they have very integrated and sound Intellectual Property Right protection system,thus the Intellectual Property Rights Barriers come into exist gradually.All in all,how to cope with the Intellectual Property Rights Barrier from developed countries like United States of America(USA)against China's high-end manufacturing industry has become an urgent and difficult problem for China.In this thesis,I provide analysis on how to deal with the IP Rights Barrier,which has important meaning for reference.In this thesis,under the guidance of management theory,economics theory as well as legal theory,with the High Speed Train as an example,I used all kinds of management methods such as SWOT analysis method,PEST Model analysis method and comparison method,etc.,I completely and thoroughly analyzed the status of China's high-end manufacturing industry and discuss how to face the IPR Barrier such as 337 and 301 investigation.After analyzing the reason and effect from the Intellectual Property Rights Barrier to China,I point out the main reasons why we encounter the IPR Barrier.At last,based on the analysis in the context in this thesis,I make suggestion on how to deal with the IPR Barrier from three levels(i.e.,government level,industry association level and enterprises level)so as to push the fast and sustainable development of China's high-end manufacturing industry and achieve the majestic goal of “Made in China 2015”.
