In recent years,adverse events related to vaccine quality and safety occur frequently in China.Such events not only reflect the harm of vaccine safety,but also reveal the need for our government to give more perfect compensation measures for the loss of vaccine quality risk.One year after the "Changchun Changsheng vaccine" incident,China officially launched the "vaccine management law of the People's Republic of China",which clearly stipulated that the vaccine marketing license holders should take the vaccine quality as the insurance object of compulsory vaccine liability insurance.As a new insurance,the insurance is aimed at a vaccine insurance market that is not fully opened The applicant and the insured with insufficient understanding of this kind of insurance are bound to face severe challenges from theory to practice.It is necessary to predict the problems that may exist in the landing of vaccine liability insurance with the help of relevant experience at home and abroad,and provide reliable solutions.Firstly,this paper takes Changchun Changsheng vaccine as an example to illustrate the necessity of compulsory vaccine liability insurance in China by describing the basic situation and follow-up compensation plan of the event.Secondly,this paper analyzes the current situation of vaccine liability loss compensation in China,describes the compensation method of abnormal reaction of vaccination in the form of social welfare,the common commercial insurance and special commercial insurance in the form of commercial insurance,and the compulsory vaccine liability insurance in the form of compulsory insurance,and interprets the relevant policies of compulsory vaccine liability insurance,and discusses the specific advantages of this insurance.Then,from the two perspectives of the applicant and the insurer,this paper discusses the possible problems in the implementation of compulsory vaccine liability insurance between vaccine manufacturers and insurance companies.Then it describes the development experience of foreign vaccine liability insurance.Taking the United States,Japan and Germany as examples,it expounds the fund mode,national payment mode and compulsory insurance mode developed according to different national conditions,and discusses the Enlightenment of foreign experience on China.Finally,from the perspectives of the government,vaccine manufacturers and insurance companies,the paper puts forward countermeasures and suggestions for the development of compulsory vaccine liability insurance in China,that is,the government should strengthen the publicity,multi-level research,small-scale pilot and establish supervision institutions;vaccine manufacturers should optimize their product quality,carry out the survival of the fittest in the industry,fully insure and strengthen the insurance Insurance companies should use their own advantages to implement the details of insurance types and develop multiple insurance types to promote the development of the industry,and spread the risks through co insurance.Finally,it comes to the conclusion that only under the joint cooperation and efforts of the government,vaccine manufacturers and insurance companies,can we speed up the implementation of compulsory vaccine liability insurance and promote the overall good development of the industry.
