Today,with the rapid development of artificial intelligence and Internet of things technology,the creation of autonomous vehicles,an application of artificial intelligence in automotive field,has attracted great attention from all walks of life.A number of network giants and traditional car companies hAEV tried their best to develop the latest autonomous driving technology,in order to occupy a place in the future autonomous vehicle market.The approaching of the era of autonomous driving has led to the increase of uncertain road risks,the transformation of risk burden subjects,and the challenge to liability insurance which occupies an important position in the automobile industry chain.Since the autonomous driving technology was turned on when the accident occurred,the driver,the autopilot manufacturer,the car manufacturer and the car seller can all be seen as potential responsible individuals.However,the technology of how to underwrite autonomous vehicle liability insurance is still in the exploratory stage.Since there is no insurance data as a reference,the solution to the problems about how to assign accident liability,how to define the accident compensation standard and how to determine the premium require the insurance company to make further design and research.But no matter how the autonomous vehicle liability insurance is designed,the transfer of insurance liability from the driver to the manufacturer is undoubtedly a major premise.This paper mainly analyzes the characteristics of mandatory,public welfare and victim protection of the compulsory traffic insurance system.The analysis shows that the liability insurance model is not clearly defined,the limitation of liability relief is limited,and the premium is not determined based on regional differences.Therefore,this paper puts forward constructive suggestions on the current compulsory traffic insurance system in the era of autonomous driving.At the same time,this paper analyzes the AEV act of the United Kingdom,European Civil Law Rules in Robotics of EU and Price Anderson Act of the United States and analyzes the enlightenment of foreign countries' legislation on the construction of liability insurance system of China's autonomous vehicle.On this basis,this paper discuss separately on the accident liability identification and compensation issues in the transition phase(semi-automatic driving phase)and the completion phase(automatic driving phase,ie unmanned phase)of autonomous vehicles,including the design of feasible insurance schemes.The structure of this paper is as follows: The first chapter is a detailed introduction of the autonomous vehicle.It mainly includes the development status of autonomous vehicle in various countries,technical principles and classification of autonomous vehicle,and the difference between autonomous vehicle and driverless cars.On this basis,the paper also discusses the remolding of auto insurance industry by autonomous vehicle.The second chapter analyzes the current compulsory traffic insurance reform in the era of autonomous driving.This chapter mainly focuses on the inherent disadvantages of the current traffic insurance system and the challenges brought by the autopilot technology to the system of strong insurance and emphasis on the legal update of the current traffic insurance system in order to adapt to the advent of the age of automatic driving.The third chapter introduces the enlightenment of extraterritorial legislation on the construction of China's autonomous vehicle liability insurance system,which are the AEV act of the United Kingdom,European Civil Law Rules in Robotics of EU and Price Anderson Act of the United States.The fourth chapter puts forward the conception of the autonomous vehicle liabilityinsurance system in China--the construction of the "compulsory double insurance" system and the corresponding legislative path.
