Compulsory automobile liability insurance(hereinafter referred to as "CALI")has been in operation for more than ten years in China,and has achieved remarkable results in solving the social problems caused by traffic accident in China.However,with the progress of society and the development of the economy,it is increasingly unable to meet the policyholders and the traffic accident victim.The needs of the traffic accident victim and the continued losses have put pressure on insurance companies operating insurance.The author believes that when CALI is no longer suitable for the needs of the current social development,the compulsory insurance system should be reformed,CALI should be cancelled,and the commercial three liability insurance should be upgraded to compulsory insurance to solve the social contradiction brought about by CALI.By analyzing the evolution process of China's compulsory insurance system and market,this paper analyzes the advantages and disadvantages of CALI in the present periods,and deduces whether it can bring a favorable situation.Through comparative analysis of the already well-established systems and management and operation systems of the world's developed insurance countries such as the United States,the United Kingdom,and Japan,we can study the places where we can learn from the policies and methods for canceling CALI.Finally,the conclusions are drawn from the three aspects of the legal basis,social foundation and market foundation for canceling CALI,and the specific implementation paths and steps are derived.
