Study On The Sample Of The Transfer Of The Right To Use The Homestead Under The Background Of "Three Rights Separated"

With the rapid development of China's economy,the gap between urban and rural areas is becoming more and more serious.Many rural residents can't meet their own living needs only by farming.In order to live a more prosperous life,most young villagers choose to work in the city to earn money.In the long run,there have been problems such as idle rural houses,no race in cultivated land,aging and early childhood of the rural left behind population.The country is also aware of the problems faced by rural areas.While promoting the integration of cities and towns,it is carrying out a series of rural land reform,including the reform of the right to use homestead.The reform of "separation of three rights" officially started in 2017,and is expected to complete the pilot work by the end of 2019 and be carried out nationwide Many problems,such as the circulation system is not easy to link up,the circulation scope is limited and so on.This paper mainly uses data research,combined with the measures that have achieved good results in the "Three Rights Separation" reform pilot,to explore the most suitable transfer mechanism of homestead use right in the region I investigated.First,the research background of this research.The site selection and regional overview of the survey are described.During the investigation of taipingzi village and Sikeshu village,it is found that there are serious idle and shelved situation of homestead in both villages,the current situation of private transfer transaction of homestead and the phenomenon of homestead occupying cultivated land found in the visit.Then combined with the results of data display,the analysis is as follows:the residents in the constituency lack of understanding of the legal and policy issues of the transfer of the right to use the homestead,the situation of private transfer in the constituency is serious,but the transfer mode is relatively simple,the villagers in the constituency have strong willingness to transfer the right to use the homestead,the disputes on the transfer of the right to use the homestead in the constituency are less,and the free transfer of the right to use the homestead does not lead to The villagers in the Sikeshu District sell their houses because of their interests,they are resistant to the household registration of the booth residents,they are more active in returning the homestead in the constituency,and the villagers in the constituency prefer money compensation.It is hoped that the results of this research can provide some help for the work of "three powers separation" in the future.In the third part of the article,the author mainly analyzes the qualitative aspects of the "separation of three powers" and the successful measures of the representative pilot areas,trying to find out the place that can be applied to the investigation area.At the end of the article,the author summarizes the above content,and puts forward a reasonable conception of the transfer method of the right to use the homestead in the pilot area based on the background of "Three Rights Separation".
