A Study On Relevant Legal Issues On Coal Resourses In China

The thesis from the angle of the strategic position and importance of coal resources in China as well as status quo of the legislation of coal resources gives depth analysis on the existing problems and setbacks in management and legislation of coal resources.After study on overseas success stories of exploitation,utilization,protection policy and system, it brings forward the importance of research on relevant legal issues on coal resources and countermeasures.Coal resources are main energy supply.However there exist such problems during the process of exploitation and utilization as destruction and waste of resources as well as security accidents,in this sense,legal research,protection and exploitation and utilization of coal resources are imperative.For the moment,many problems remain unsolved in legal aspects including the loss of relevant law,irrational industry access mechanism,imperfect mechanism for paid use of coal resources,irrational imposition of taxes and charges,impractical relevant measures and weak law enforcement. in response to these problems,the following countermeasures have been put forward.Firstly,we should improve the relevant legislation,enforce Industry admittance strictly,strengthening ecological protection in mining areas,improve paid use of resources system,set up strategic reserve system and revise coal law.Secondly,we should improve law enforcement mechanism,clarify property right,set up early warning system for exploitation,improve enforcement supervision mechanism, implement responsibility system and set up mandatory training system. Thirdly,we should intensify outreach of rule of law,saving resources and environmental protection.
