Abstract/Summary:
This thesis examines Eritrea's options in developing carriage of goods by sea law. It argues that Eritrea's adoption of the United Kingdom's Carriage of Goods by Sea Act of 1971 is not necessarily the best option. Alternative options are discussed in a comparative study of the Transitional Eritrean Maritime Code, Draft Eritrean Maritime Code, International Convention for the Unification of Certain Rules of Law Relating to the Bills of Lading, 1924, International Convention for the Unification of Certain Rules of Law Relating to the Bills of Lading as amended by the Brussels Protocols of 1968 and 1979, United Nations Convention on the Carriage of Goods by Sea, 1978, Draft Convention on the Carriage of Goods [Wholly or Partly] [by Sea], and jurisprudence. It concludes that Eritrea should consider developing a regime, which draws upon the Hague-Visby Rules of 1968 as amended in 1979, and the Hamburg Rules of 1978.
