Abstract/Summary:
This thesis takes an in-depth look into the varied realities faced by women in the sex trade. Predominant feminist theories within the prostitution debate are broken down and critiqued. Arising from this critical analysis is the development of a spectrum of prostitution. This spectrum attempts to recognize the experiences of all women in prostitution, encompassing both victims of human trafficking and high-end sex workers. The spectrum of prostitution is then applied to the decision in Bedford v. Canada (Attorney General) (2010). This case analysis works to demonstrate how the law should apply the spectrum, and the potential implications that may arise when the court fails to recognize the most marginalized women within prostitution.
