Abstract/Summary:
In March 2003, Christina Wilkerson was brutally murdered. The accused is an illegal immigrant from Mexico with multiple felony convictions.; Prior to being released from prison the last time, Santiago Manuel "Shady" Martinez was deemed a high-risk sex offender. He was subject to standard and special parole conditions, including outpatient psychiatric care.; But "Shady" Martinez never met his parole agent. Instead, Immigration and Customs Enforcement deported him in December 2002, and the Department of Corrections lapsed in enforcing his parole conditions under the naive notion that the border provides a measure of protection that voids the need to monitor illegal parolees.; "Shady" Martinez returned to the United States within a week, and four months later Christina was dead. This case illustrates the problems of a system that fails to acknowledge the danger of not supervising illegal immigrant parolees under the same standards applied to criminals who are U.S. citizens.
