Abstract/Summary:
The Three Strikes law was designed to reduce crime rates, but this approach is inconsistent with certain widely accepted theoretical justifications for punishment within the liberal societies, particularly the utilitarian argument. The legislation for the Three Strikes law was driven not so much by thoughtful efforts to craft effective public policy as by the need of politicians to respond rapidly to public passion.
