Abstract/Summary:
In human genetics physician liability is influenced by the nature of the information, the patients and by the physicians themselves. Moreover, genetic characteristics transform the medical approach from diagnostic and curative to predictive and pronostic. As a result, the legal duties of the physician are also transformed. Furthermore professional norms also plays a role. This essay describes the legal liability of the physician within human genetics. The traditional medical duties, to obtain an informed consent, to respect confidentiality, to treat the patient and to give appropriate follow-up in the respect of professional standard of care, are defined. Furthermore, the perception of the physician duties in human genetic are examined in order to go as to analyze their conformity to legal duties.
