| As the Digital Age has dawned, so has a new way of life in which society has become completely dependent on digital devices to navigate all aspects of everyday life, even criminal activity. As technologies continue to evolve, so do criminals who are constantly looking for new ways to subvert the law. As crime and criminals continue to evolve, so must the digital investigators in law enforcement who work tirelessly to uphold the law in a relatively new and constantly evolving domain. This research offers a focused look in to the challenges presented to law enforcement by big data and encryption, not only covering technical challenges, but legal ones as well. After discussing current literature surrounding these topics, this research examines some of the best strategies for mitigation to the problems presented to law enforcement. Finally, it explains how these mitigations will impact the digital investigation process as well as criminal justice procedure. |
