Research On Legal Issues Of Urban Construction Waste Recycling In China

This paper starts from the concept of urban construction waste and its resource,and demonstrates the necessity of legal adjustment of the process of construction waste resource through the elaboration of theoretical basis.In the practice of circular economy,the practical difficulties faced by the recycling of construction waste are: the nonstandard source classification treatment,the development differences between the resource-based enterprises and the low market recognition of the resource-based products.These issues require a response from the mandatory system.Through the analysis and interpretation of the current legal texts,it is found that there are some problems in the process of urban construction waste recycling,such as imperfect legal standard system,lack of special legislation,unclear responsibilities of the main body of supervision,legal system in the stage of resource-based treatment and the lack of application system of resource-based products.Based on the experience of German,Korean and Japanese construction waste recycling legal system,combined with the current practice of the laws and regulations of construction waste recycling in China,the paper puts forward the concrete countermeasures to improve the legal problems existing in the recycling of construction waste in China.First,we should focus on improving the legal system of the stage of construction waste generation,including the improvement of the legislation system of construction waste resource,including clarifying the subject of resource-based obligations,coordinating the conflicts between existing laws and regulations,and issuing special regulations.At the same time,we should improve the approval system of construction waste disposal and the supervision system of the main body access of construction waste resource,and finally improve the certification system of the construction waste resource-based products and the government green procurement system.To solve the legal problems in the process of construction waste resource,and to realize the further development and perfection of the circular economy legal system.
