The Study On Appyaisal And Evaluation System Of Ecological Environment Damage

With the increasingly serious environmental problems in China,more and more attention has been paid to the damage of the ecological environment itself.It is an important measure to try out the compensation system for the damage of the ecological environment nationwide.The appraisal and evaluation of ecological environment damage is an important part of compensation and restoration of ecological environment damage.At present,the legal system of compensation for ecological environment damage has not been established in China,and there are still many problems in the appraisal and evaluation system of ecological environment damage.The main body of this paper is divided into four parts.In the first part,by comparing the definition of ecological environment damage and environmental damage,the scope of ecological environment damage appraisal and evaluation system is defined.The second part is to sort out the current legislative situation of the appraisal and evaluation system of ecological environment damage,andsummarize the existing problems from the existing relevant provisions.At present,there are five major problems: the lack of unified legal provisions in the appraisal and evaluation system of ecological environment damage,the imperfection of the appraisal and evaluation system,the unclear provisions on the responsibility of the appraisal and evaluation subject,the inconsistent ownership of the right to start the procedure,and the inconsistent provisions on the participation of the appraisers in the cross examination.The third part is the reason analysis,from the appraisal evaluation system lack of legal protection,appraisal subject access and responsibility investigation system is unreasonable,appraisal evaluation procedure operation is not standardized.The fourth part is to put forward the corresponding improvement suggestions for the above problems.The first is to improve the legal provisions of the appraisal and evaluation system of ecological environment damage;the second is to establish a specialized appraisal and evaluation institution of ecological environment damage,which has two main points: standardizing the main body system of appraisal and evaluation of ecological environment damage,unifying the access conditions of appraisal and evaluation institutions serving consultation and litigation;improving the accountability system of appraisal and evaluation subjects,and relaxing perjury The applicable conditions of crime.The third is to improve the operation standard of the appraisal and evaluation procedure of ecological environment damage,make clear that the right to start the procedure belongs to the compensation right holder,and strengthen the cross examinationobligation of the appraisal and evaluation person.The purpose of this paper is to study the appraisal and evaluation system of ecological environment damage,summarize and analyze the shortcomings of the local regulations,and provide some suggestions for our country to formulate the unified and standardized management methods in the future.
