Research On The US Trade Remedy Investigation And Countermeasures Against China

In recent years,trade frictions between China and the United States have been frequent,and the Sino-US trade war has intensified.The United States has used the pretext of protecting national security to impose tariffs on the one hand,and on the other hand,it also conducts dual anti-dumping investigations against China.China should use multilateral trade rules to protect the interests of enterprises and the country.Interests and maintain China’s share of the international market.China will develop cooperation and win-win relations with other countries and actively respond to the actions of the United States in its own way.In the process of consultation between China and the United States,we still have to require the United States to abide by multilateral rules and cannot rely on the United States.This unilateral rule does not conform to the legal basis.This article first summarizes the theory of trade remedy,researches and combs the legal evolution and historical origin of trade remedy and organizes the literature related to Sino-US trade remedy in combination with current affairs hotspots.Secondly,it has a deep understanding of the trade remedy system and the US trade remedy investigations against China and a specific study of the US trade remedy investigations on the world and China and their related impacts from the three aspects of country,quantity and industry.Third,this article selects two specific cases of the United States to analyze Chinese prefabricated steel structure products and ceramic tile products.Among them,"prefabricated steel structure products" won the lawsuit.Through case analysis,it is concluded that China is dealing with three problems in the US trade remedy.One is the problem of Chinese market economy status;the other is the issue of "substitute country";the third is that China lacks corresponding talents.First,the government should make rational use of multilateral trade rules and undertake the mission of safeguarding the multilateral trading system;the government should set up relevant institutions to guide enterprises to actively respond to litigation and resolve disputes with “laws”;third,they must guide enterprises to increase innovation and establish Chinese brands.The research in this article will help China better respond to US trade remedies,and also provide a reference for future trade remedy investigations from other countries,and improve Chinese foreign trade development environment to a certain extent.Therefore,an in-depth study on the issue of "trade remedies" is not only necessary,but also very urgent,with very profound practical significance.
