Research On The Environmental Legal Issues In The Qinling Villa Case

Qinling,Shaanxi,as a barrier to natural ecological security in China,plays a vital role in protecting the entire ecological environment and natural climate of Shaanxi Province.Since2003,the illegal construction of villas in the northern foothills of Qinling has occurred one after another,and the central leadership has repeatedly issued instructions.The stubborn illness of illegal construction of villas in Qinling has never been resolved.,Until the last out of control."Ecological prosperity leads to civilized prosperity,while ecological decline leads to civilized decline." The Qinling villa incident has been happening for almost two years now,but environmental legal issues exposed through the Qinling villa case are still worthy of our study.By summarizing some legal issues related to the Qinling villa case,finding effective countermeasures can not only protect the beautiful Great Qinling in Shaanxi,but also provide an important reference for the ecological protection of other regions.Through research,it is found that,in terms of environmental legislation,part of the local laws and regulations of Qinling is ambiguous.The scope of restrictions on real estate development in the northern foothills of Qinling is not clear.In terms of environmental law enforcement,due to various interests,some environmental law enforcement personnel abused their powers in villa development activities to approve villa projects in violation of regulations;in the remediation of some illegally built villas,there are serious problems of law enforcement inaction and lack of initiative in law enforcement.Failure to investigate and deal with illegally built villas;in the supervision of illegally built villas,the law enforcement is not strict,and the situation of illegally built villas is not carefully checked.In view of environmental law enforcement issues,it is recommended to strengthen the assessment and evaluation of environmental law enforcement personnel and strengthen the environmental responsibility accountability system to restrain their law enforcement actions.In terms of environmental supervision,by reflecting on the Qinling villa case,on the one hand,it reflects the lack of accountability mechanism for local environmental administrative supervision in Qinling,on the other hand,it exposes the weakness of Qinling’s local social supervision andjudicial supervision.In this regard,it is recommended to implement the Qinling Ecological Environmental Protection Lifetime Accountability System,improve the Qinling Social Supervision System and improve the environmental judicial supervision mechanism,and finally construct a complete Qinling Ecological Environmental Protection Supervision System.
