Research On Administrative Assistance In River Environment Management

The refinement of division of labor in modern society promotes the development of administrative activities to specialization.However,the administrative management system with clear authority is difficult to adapt to the complex social life.In the field of river environmental management,the authorities of environmental protection include the departments of ecology and environment,departments of natural resources,departments of health commission,departments of housing and urban rural development,departments of agriculture and rural affairs,departments of forestry,as well as the water resources protection institutions of important rivers and lakes.The decentralization of the authority of many administrative subjects and the integrity of river environmental governance present a contradictory situation.In addition to the problems such as the overlapping of the authority among the environmental protection functional departments,the various departments in river environmental governance need to cooperate with each other in order to make the environmental protection function perform uniformly and comprehensively.In fact river environment administrative assistance is an institutional arrangement for administrative subjects to effectively perform administrative functions and powers,give full play to the overall efficiency of administrative activities,improve administrative efficiency,reduce administrative costs and save public administrative resources.Administrative assistance of river environment refers to the act that an organ with the function of river environmental protection is unable to exercise its power of environmental management due to legal or practical reasons,and makes a request for assistance to an administrative organ without affiliation,and the requested organ exercises its power and provides assistance according to law.In practice,due to the lack of unified legal norms,the administrative assistance of river environment is faced with such dilemmas as unclear subject,disordered procedure,responsibility attribution and imperfect dispute resolution mechanism,which also leads to serious problems of prevarication and power struggle among administrative organs,low efficiency of assistance,and deviates from the original intention of system design.River in the development of environmental administrative assistance system need to rely on the constant improvement of relevant laws.This paper focuses on how to develop the environmental governance specialized laws and regulations,administrative assistance specific content includes the concept of environmental administrative assistance,procedures,applicable conditions,main body,expense,refused to help the situation and solve the contradictions of the legal policy,legal responsibility and so on.At the same time,to promote "Internet +" administrative assistance and river environment fusion,should build a unified platform for the "Internet + river environmental administrative assistance",standardize administrative assistance process,and established by the competent department of environmental protection is given priority to,other environmental protection departments to assist river environment information sharing mechanism,on the river environment to collecting,sorting and utilization of large data.In addition,the regional characteristics of river environment need to play the role of river chief system,the overall interests of the basin,to strengthen the inter-regional administrative assistance.
