| Collaborative governance of river basins is the future direction of the current cross-administrative water pollution governance model.For cross-administrative district water pollution,the existing governance models,namely the "river chief system" and "regional collaborative legislation",are unable to provide substantial support for cross-provincial water pollution governance.,In-depth collaborative governance solution path.In the "Yangtze River Protection Law of the People’s Republic of China",it has clearly proposed to establish a coordination mechanism for overall governance,improve the supervision and security mechanism and a series of measures related to cross-administrative water pollution control.The problem must be based on the entire river basin to carry out the coordinated governance of the whole river basin,improve the cross-administrative water pollution collaborative legislation in the basin,improve the supporting legal mechanism for the inter-administrative water pollution collaborative governance within the basin,and promote the improvement of the internal and external supervision legal mechanism.The coordinated management of water pollution in the administrative region provides a strong policy and legal guarantee.Provincial administrative units will be driven by the rationality of "economic people" when they carry out water pollution control across administrative regions.The existence of multiple responsible subjects will inevitably lead to each subject taking the least payment to obtain the maximum benefit due to the mutual interest competition relationship.Therefore,whether it is the intra-provincial collaborative governance carried out by the "river chief system" or the "regional collaborative legislation" adopted by the inter-provincial governance,it is difficult to form a continuous,stable and systematic model for water pollution control across administrative regions.In order to realize the transformation from the "river chief system" and "regional collaborative legislation" representing the coordinated governance of some regions in the river basin to the overall river basin collaborative governance,the river basin management committees of each river basin should be the leading role,and the administrative units in the river basin should be encouraged to interact with each other.Cooperate to carry out collaborative governance,supplemented by corresponding legal mechanisms and supporting systems,to achieve collaborative governance of water pollution across river basins and administrative regions.The purpose of this paper is to study the current situation,predicament and countermeasures of my country’s cross-administrative water pollution collaborative governance,using literature research methods,comparative research methods,and empirical research methods.Through the investigation of the system "River Chief System" represented by the synergy within the province and the legislative activities of the "Chishui River Regulations" carried out by the three provinces of Yunnan,Guizhou and Sichuan represented by the synergy of some regions in the basin.The organizational structure and operation mode of the "River Chief System" were analyzed,and its shortcomings were found;the "Chishui River Regulations" of the three provinces of Yunnan,Guizhou and Sichuan were compared,and the reasons behind the differences in the regulations of the three provinces were explored.Through the above methods,we can provide some results that can be used for reference for the collaborative governance of water pollution in my country’s river basins and across administrative regions.The first chapter is the introduction,the research background and significance of the inter-administrative water pollution collaborative governance,the review of domestic and foreign related literature,the research methods and innovations.The first chapter introduces the related concepts and theoretical basis of water pollution across administrative regions;the second chapter introduces the current status of the legal mechanism of water pollution across administrative regions in my country;The current situation of legislative coordination and governance conducted between the two countries is investigated,and the dilemma faced by my country’s cross-administrative water pollution is analyzed,namely,the cross-administrative water pollution legislation is not perfect,the coordination mechanism is not perfect,the supervision is absent,etc.;The experience and inspiration of collaborative governance of water pollution across administrative regions;the fourth chapter summarizes the improvement of the legal mechanism of water pollution across administrative regions in my country’s river basins.The legal mechanism,promoting the improvement of the internal and external supervision legal mechanism;the fifth chapter is the conclusion of this article. |
