The Preliminary Study On The Folk Debt Relationship In Linxiang Area In The Middle Of The Eastern Han Dynasty

In the middle of the Eastern Han Dynasty,the folk debt relationship in Linxiang area developed rapidly under the comprehensive effect of many factors,such as the unique geographical location and natural environment,convenient land and water transportation and mature commodity economy,and showed a more distinctive era and regional characteristics.This paper will use the bamboo slips of the Eastern Han Dynasty published recently in Wuyi Square of Changsha to investigate the folk debt relationship in Linxiang area in the middle of the Eastern Han Dynasty.According to the bamboo slips of the Eastern Han Dynasty in Changsha Wuyi Square,the main types of the folk debt in Linxiang area include physical debt and monetary debt,which are equally developed and play the same important role in the local folk debt relationship.Judging from the social identity and geographical sources of the parties,the people who participated in the folk debt activities in Linxiang area at that time almost covered most parts of the country and all social strata,reflecting the frequent daily exchanges between Linxiang area and other counties in various fields of social economy to a certain extent.At the same time,from the perspective of every link in the process of the occurrence and dissolution of the private debt relationship,there are various ways to cause the occurrence of the private debt relationship in linxiang,including borrowing,tenancy,employment,trading,leasing,torts,unjust enrichment and so on.The two most common forms of law,covenant and guarantee,are the basis for the establishment and recognition of these debt relationships.When the debt relationship between the two parties cannot be terminated normally,the creditors can protect their own interests by means of either private recourse or recourse to the government,and there are many ways to choose in terms of specific debt repayment,which indicates their flexibility in the termination of the private debt relationship.In addition,in the middle of the Eastern Han Dynasty,the performance and characteristics of the folk debt relationship in Linxiang had a great impact on some aspects of the local society.First of all,in terms of the development degree of currency economy,the local metal currency economy showed a certain prosperity under the stimulation of the private debt relationship in Linxiang.However,the real existence of grain debt made the physical currency represented by rice unable to completely withdraw from the circulation field.Secondly,in the middle of the Eastern Han Dynasty,the flourishing of private debt activities in Linxiang and the frequent non-performance of debt caused the excessively high level of personal debt in the region.Finally,with the decline of the central government’s intervention in the folk debt activities in the Eastern Han Dynasty,a new form of debt repayment was gradually emerged in the local society,in which the debtor no longer went through the government intermediary,but directly took the place of the creditor to serve in service.
