| The administrative interviews are the activities and processes that the administrative subject invite administrative counterpart to talk for administrative purpose within administrative purview.The administrative interview is independent and non-mandatory administrative action,we should distinguish it from the internal interviews,administrative guidance and administrative investigation in practice.Administrative interviews are the important system components of building government of law and service.Administrative interviews,administrative incentives,administrative guidance,and administrative contracts are the important initiatives during the process which administrative subject plays a leading role in the diversified system and mechanism of social governance.Administrative interview’s institutional practice can not avoided inherent powers expansionary as it demonstrates strong vitality,so its alienation grows by its field expansion.Administrative interview’s alienation manifests as administrative interview’s coerciveness,excessiveness and the benefits exchanges in the course of the interview.The coerciveness manifests as illegal setting liability and being forced to participate interviews.Benefits exchanges including interests are based on departmental and interests.The causal relationship includes internal and external factors,the internal factors of administrative interview’s alienation has three contradictions in the process of power running as well as partial rail institutional design.The three contradictions are the conflicts between the rights of owners and users,rulers and the ruled,the public interests and private interests.At the same time,the institutional design includes the unclear role of government,unequal rights and obligations,unscientific and undemocratic designation of system.The external factors mainly be reflected as the legal absence,supervision blur and ineffective relief.Administrative interview should be restrained by law for its necessity of the system.Currently,administrative interviews is still during exploratory stage of the ministries and local governments.This article tries to put forward some elements of the standardization that including purposes,basic principles,scope and procedural norms which are the experience explored by the local governments.Although with the lack of flexibility,the standardized administrative interview system meets the requirements of the social governance systems based on the governance according to the law.Standardized administrative interview could also effectively avoid the administrative interview’s alienation and realize the balance of efficiency and fairness. |
