Research On The Generative Logic Of Socialist Law Road With Chinese Characteristics

After the Eighteenth National Congress of the CPC convened,our country pay more attention to the development of law road.In particular," the law in China" was proposed,which requires in-depth study of China’s law road with Chinese character.Compared with the western law road,it is not difficult to find that Chinese character of law road mainly reflect on the historical and cultural traditions,national conditions,and other aspects.In this study,I try to explore the generative logic of our country’s law road from the logic of historical evolution,the logic of cultural development and the logic of realistic,in order to emphasize Chinese character of China’s law road,avoid assuming the construction of law road from the perspective of pure logic and prevent blindly transplanting the western concept and system of law road.This study is divided into five parts to elaborate the generative logic of our country’s law road.Firstly,combing the course of exploration and development of our country’s law road and clearing the propose process of the concept of "socialist law road with Chinese characteristics",which provides theoretical basis for the exploration of generative logic of law road.Secondly,on the basis of clearing the developing process of China’s law road,I analyzes the unique characteristics of it,which is adhering to the unity of the party’s leadership,the people in power and the rule of law.Analysising deeply the relationship between the three,we can understand the distinctive difference between Chinese law road and western law road.Thirdly,I explore generative logic of the law road form the historical evolution,which go from the elite governance model to the Party leadership.Analysising the theoretical basis and operating mechanism of Elite Governance,we can absorb the outstanding and reasonable elements of Elite Governance,so as to enrich our country’s theory of adhering to the party’s leadership.Fourthly,I explore the generative logic of our country’s law road from the cultural development,which is insisting the rule by law and virtue.And it is the inheritance of ancient thought of morality and law.So I want to explore the method of how to implement the dual-purpose thought of morality and law to our modern society.Finally,I explore the generative logic of our country’s law road from the reality,which is adhering to the localization of development.Exploring the necessity of the implementation of the localization of development and absorbing the lessons of localization development in some countries,so we can promote the law road in China to localization development.
