In ancient China,the relationship between man and woman is generalized as"man is superior to woman",which is varied at different historical stage,and the rights of woman in the family and marriage is the basic form of expression for the women’ s status.he Tang dynasty is one of the most prosperous dynasties in ancient China.it created a brilliant civilization and prosperity.Its political,economic,culture and other aspects have been unprecedented developed.It is the highly development of politics and economic that made Tang Dynasty vibrant,confident,generous,inclusive in many sides,which also improved the status of women.This paper focused on the status of women in Tang Dynasty.The author makes the divorce institution as a breakthrough point,and analyzes the status of women in the Tang Dynasty through the case of divorce practice.The Paper consists of five parts.The first part,Introduction,mainly elaborated the reason of the topic,the domestic academic circles on the Tang Dynasty divorce system,the status of women’s research and development,and ultimately point out the innovation of this article.The second part,from the ’Yi Jue’ institution and its practice to see the status of women in Tang Dynasty.Starting from the content of ’Yi Jue’,and then deduced the characteristics of the system and its legal consequences.After that it lists the the social practice of’Yi Jue’.In the end it analyze the Tang Dynasty women’s status from the perspective of ’Yi Jue’.I believe that the ’Yi Jue’ has protected the women’s rights and interests to a certain extent.After all,women can divorce men when their husbands hurt them and their relatives.However,wives burden much more than their husbands.Each of them in the legal provisions are unequal,and profoundly embodies the social characteristics of male superiority.The third part,from the ’Qi Chu’ institution and its practice to see the status of women in Tang Dynasty.First of all,it elaborates the contents of the seven systems stipulated in the Tang Dynasty,and then compares the content and location of the ’ Qi Chu’ of the Ritual system,and explores the deep implication behind the change.Followed by analyzing the ’Qi Chu’ one by one through some specific cases.Finally,it concludes that the institution is essentially oppressive to women.The essence is to safeguard the interests of the clan.Even if the Tang law also stipulates that ’San Bu Qu’ to protect women’s rights and interests,but eventually,women still can not escape the husband-led family order.The fourth part,from the ’He Li’ institution and its practice to see the status of women in Tang Dynasty.Starting from the content of the ’He Li’ and its characteristics,it explains ’He Li’ through the specific practice.And then specifically through the Dunhuang’s wife’s letter to discover the institution at the time and pointed out that the institution need to follow the prescribed procedures.Finally,it shows that the women still enjoy certain right of divorce,property right and remarriage in the Tang Dynasty,and points out the status of women in the Tang Dynasty have been improved to a certain extent.The fifth part points out that the reason of the relative improvement of the status of women in the Tang Dynasty.It concludes that the Tang Dynasty has created a relaxed environment for the improvement of the status of women from the aspects of the influence of the customs of the ethnic minorities in the Tang Dynasty,the liberalization of the traditional rites and the economic and political development of the Tang Dynasty.The sixth part,conclusion,summarizes the full text.
