Discussion On The Path Of Legalization Of Complaint-related Petition Work

Complaint reporting involving litigation,judicial and other areas refers to the complaint reporting behavior,generally is linked with a lawsuit case,refers to the people take the form of a visit or letter,because they can not agree with the judicial organs of the trial process or results,and ask the judicial organs to start judicial procedures,the implementation of certain litigation behavior.In addition to litigation and reconsideration procedures,this system is an important means to resolve disputes and safeguard rights and interests.At present,our society is in the stage of transformation of society governance under the rule of law,the problem of complaint involving lawsuit,is common in the public mind the concept of the "complaint reporting not letter law" than the law weapon tend to be more through letters and way to solve the problem,once influenced the judicial authority,and in this context,how to improve the complaint involving lawsuit mechanism construction,be included in the process of rule by law is particularly important.Due to the institutional obstacles,the dilemma of satisfying the reasonable demands of the public and maintaining the judicial authority,the difficulty of the working system and mechanism,and the abnormal behavior of the complainants,the complainants’ complaint reporting work has fallen into many difficulties.The author thinks that to improve the system of complaint involving lawsuit,implement v.visit to separation,promoting judicial reform and perfect the judicial relief,strengthen management of complaint involving lawsuit,end in accordance with the mechanism,the measure such as open channels of complaint reporting,build a good judicial and reporting environment,create good atmosphere of "law",promote the construction of complaint involving lawsuit under the rule of law.The research of this paper is divided into six parts.The first part introduces the research background,purpose and significance of this paper.The second part introduces the related concepts and theories.The third part analyzes the current practice of complaint reporting in T county and finds out the reasons for the problems,The fourth part analyzes the difficulties encountered by the complaint-related complaint reporting in China from the perspectives of jurisprudence,public opinion,relief and rights,and discusses how to identify and position the status,function,mode,function,procedure of the complaint-related complaint reporting.The fifth part constructs the litigation petition mechanism from the legal thinking mode.The sixth part is the summary of the paper and the prospect of future research.
