International investment is an important form of cooperation between countries.International investment is mainly in the form of investment agreements,which are signed to effectively protect the interests of the recipient countries and host countries.The investment agreement stipulates the rights and obligations of both parties.Both parties to the investment shall abide by the provisions therein.The vigorous development of international investment will inevitably bring about environmental problems,and environmental deterioration will bring increasingly serious harm to the country and even the whole world.Therefore,it is necessary to include environmental protection clauses in the international investment agreement.There are many potential problems in the current environmental protection clauses,which cannot meet the needs of the current social development.Therefore,it is urgent to improve the environmental protection provisions.This paper studies in the international investment agreementthe environmental protection clauses to seek some solutions,In the environmental protection clauses,It make a contribution to the improvement.The first part of this paper mainly focuses on the environmental problems caused by some typical investments around the world.Describe a series of serious hazards caused by environmental problems.Thus leads to the argument of the thesis-the importance of environmental protection to international investment.The second part mainly introduces the basic theory of environmental protection clause.In the starting point,Taking the relationship from international investment to environmental protection,this paper introduces the emergence and development of environmental protection clauses in international investment agreement.The paper mainly discusses the forms of environmental clauses,which are preamble environmental clauses,special environmental clauses and environmental exception clauses.Then it describes the new development of environmental protection clauses at present,showing the new vitality of environmental protection clauses.The third part briefly introduces the legislation about environmental protection statoins clause in investment agreement.It mainly focuses on multilateral investment agreements,regional investment agreements and bilateral investment agreements.Finally,the bilateral investment treaty(bit)is gaining popularity among investors because of its increasing flexibility.In this paper,the fourth part from the following five aspects:summing up the law of environmental protection clause is a typical problem,specifically the environmental protection provisions conflict with the terms of investment,environmental protection the lack of specific content,applies fuzzy,lack of legally binding terms of environmental protection,environmental protection clause the monotony of shortage and environment protection clause.In the fifth part of this paper,the above part is the pointcut,aiming at the above five problems,the corresponding solutions are proposed.They are how to coordinate environmental protection clauses and investment clauses,clarify the connotation of environmental protection clauses,enhance the legal binding force of environmental protection clauses,increase the number of environmental protection clauses so as to improve environmental standards and enrich environmental protection clauses.China must abide by the environmental protection provisions of the international investment agreement in both foreign investment and foreign investment,because we have deeply felt the importance of environmental protection.Our country now advocates "green water and green mountains are mountains of gold and silver",we should pay attention to the importance of environmental protection.learning the importance of improving environmental protection about investment.our society will be better and better.The better the environmental protection,the better the long-term investment.About the international investment agreement,the word should abide by the environmental protection.Only in this way about improving the environmental protection provisions and paying attention to the awareness of environmental protection can we make better progress in international investment and benefit future generations.Countries may be both host countries and investment countries.Throught Learning to do with the relationship from investment to the environment,so as to obtain permanent benefits.We should also take a great responsibility to protect the environment in our investment,so as to achieve sustainable development in the long run.
