Problems And Improvement Of Relief Mechanism Of Government Information Disclosure In China

With the continuous development and improvement of the level of rule of law in China,people’s demand for government information is increasingly strong,and government information disclosure has become one of the daily affairs of administrative organs at all levels.The promulgation and implementation of "the regulations of the people’s Republic of China on government information disclosure" provide legal basis and support for the government information disclosure in China,and to a certain extent,protect citizens’ right to know.But,without relief,there is no right.On the one hand,relief is the guarantee of government information disclosure,and it is also an indispensable part of government information disclosure system.China’s"Regulations on the government information disclosure" is too simple and general in terms of rights relief,which makes it difficult for citizens’ legitimate rights and interests to be effectively protected in the practice of specific government information disclosure.Therefore,it is imperative to improve the relief mechanism of government information disclosure.This paper mainly studies the relief mechanism of government information isclosure in China by literature research and case analysis.Combined with typical cases to analyze its operation status and characteristics,find out the existing problems of the current mechanism.This paper analyzes the deep reasons behind the problems,and finally puts forward the countermeasures and suggestions to improve the relief mechanism of government information disclosure.The purpose of this paper is to provide reference ideas and methods for improving the mechanism of government information disclosure in China.This paper introduces the current relief mechanism of government information disclosure,including its legislative provisions,complaints and reports,administrative reconsideration,administrative litigation,etc.Combined with the analysis of typical cases of government information disclosure,this paper summarizes the current operation characteristics and existing problems of the relief mechanism of government information disclosure in China,and analyzes the reasons behind the problems from the relief subject,relief system,relief procedure and relief results.Finally,combined with the actual situation,this paper puts forward some suggestions to improve the relief mechanism of government information disclosure,including improving the public awareness and knowledge of government information disclosure relief,establishing a complete legal system of government information disclosure relief,standardizing the relief procedure of government information disclosure,increasing the way of compensation and relief,and setting up the office of government information commissioner.
