With the gradual melting of the Arctic ice,the commercial value of the Arctic shipping routes has greatly improved.The Arctic shipping routes has a huge advantage over the traditional waterway.It is the shortest route connecting East Asia with Europe and North America.As a near-Arctic country and an Arctic stakeholder,the opening of the Arctic shipping routes is of great significance to China.The Arctic countries also pay great attention to the control of the Arctic shipping routes to protect their interests in the Arctic.This article revolves around Canada’s legislative policy on the Northwest Passage and Russia’s legislative policy on the Northeast Passage,with a view to seeking a foothold in China’s involvement in the Arctic interests.Based on the theory of Arctic shipping routes navigation,this paper clarifies the status of Arctic shipping routes in international law and its shipping value,analyses the legislative practice of the Northeast and Northwest passage in Russia and Canada,studies the domestic legislation and policies of the two countries,and explores the legal path of China’s participation in Arctic shipping routes navigation.Firstly,it introduces the geographical overview of the Arctic Channel and the shipping value.It details the geographical location of the Northeast Passage and the Northwest Passage and its advantages over the traditional fairway.It also introduces the status of the Arctic Channel in international law.It is the international law that identifies several Arctic waterways and the international treaties related to the Arctic,laying a theoretical foundation for the establishment of a perfect Arctic waterway legal system.Secondly,it sorts out Russia’s policy changes and legislative practices in the Northeast Waterway,and compares the conflicts between Russian domestic legislation and the United Nations Convention on the Law of the Sea.It then analyzed Canada’s legislation on the Northwest Passage,the water navigation system,and the current dispute over the Northwest Passage.Finally,the path for China to participate in the navigation of the Arctic channel,starting from the inseparable relationship between China and the Arctic and China’s participation in the Arctic navigation as a starting point,to ensure China’s better participation in the Arctic affairs,rational use of the Arctic channel,and propose China’s participation path to advise China on how to intervene in the Arctic waterway governance.On the basis of the existing arctic governance mechanism,we will establish a more complete legal system for arctic shipping routes,strengthen the study and use of existing international treaties,incorporate Arctic shipping routes into the "One Belt And One Road" initiative,and work for win-win cooperation with arctic countries to build a community of Shared future for mankind. |
