On The Privacy Protection Obligations Of Mobile APP Providers

With the development of digital technology,personal privacy can be recorded with the characteristics of personal information.With the wide use of mobile app,mobile terminal becomes personal information center.The mobile app provider collects a lot of personal information and forms a powerful database in the process of providing services for users by using the app installed in the mobile terminal and combining the advantages of technology.Through in-depth analysis of information,almost all personal information is related to privacy,which poses a new challenge to the protection of personal privacy.The first chapter of this paper,from the perspective of mobile app providers,combined with relevant theories and laws and regulations,gives the exact concept of mobile app and its providers,analyzes the characteristics and use risks of mobile app,and then expounds the emergence and characteristics of information privacy.The second chapter theoretically analyzes that the privacy protection obligations of mobile app providers come from legalobligations and contractual obligations,which also have the dual attributes of "public" and "private".The third chapter starts from the practice,according to the relevant laws and regulations to find out the problems and reasons when mobile app providers fulfill their privacy protection obligations.In the fourth chapter,in view of the existing problems,combined with foreign experience,the author puts forward suggestions to improve the relevant legal system and principle system,balance the status of both sides,enhance the user’s control of personal information,and urge the mobile app provider to actively perform the privacy protection obligations.In a word,under the background of mobile app infringing personal privacy increasingly,China should improve the relevant legal system,regulate the behavior of mobile app providers,and strengthen their privacy protection obligations.
