Face recognition technology is one of the biometric tools or methods used for identity recognition and verification.It relies on devices and algorithms to collect and process facial characteristic information,then to create a searchable facial characteristic information database to identify or verify personal identity.Backed by the interconnection of new technologies such as big data,as well as digital advancement and combined innovation,the application landscape of face recognition technology has expanded unprecedentedly.The current face recognition technology has penetrated almost all areas of social life,benefiting the society by promoting government control,institutional law enforcement and commercial use,finally liberating and developing the productive forces led by scientific and technological innovation.The social application of face recognition technology breaks and subverts traditional thinking,making facial feature information which was not valued by social values and legal regulations in the past become important.It increases the risk of social public personal information being identified,and directly threatens privacy,the personal and property interests of personal information,dignity and freedom of information erodes the anonymity of personal information.Current personal information protection laws are difficult to solve these problems.How to absorb the risk prevention and regulatory rules of personal information in face recognition technology into the personal information protection law,so as to ensure that while maximizing the innovative development and active use of face recognition technology,it can prevent the risks to the greatest extent.Brought by the application of recognition technology,balancing the personal interests,commercial interests and public interests of personal information in face recognition technology has become aphenomenon that must be regulated by law.Based on a full understanding of the technical principles and security risks of face recognition technology,this article analyzes its characteristics in the collection and processing of personal information,and conducts an in-depth analysis of the difficulties faced by the application of face recognition technology through legal status and related issues in case practice.Drawing lessons from information practice legislation in different jurisdictions,and combining with China's local reality,it aims to provide comprehensive relief to a series of problems exposed in practice in China's personal information protection,and to explore the establishment of a high-level,multi-domain,and full coverage approach of the legal system for the protection of personal information.By exploring the value considerations,balance of interests and system selection related to personal information security,it seeks to find a balance between personal rights,industrial development and social well-being.
