Research On Commutation System

Commutation system,as a penalty execution change system,is clearly written into the criminal code of our country,which fully shows the importance of commutation system in our country.Commutation as an important part of penalty execution,and serious in promoting criminals reform,play an important role in saving judicial resources,but with the development of the society,the development of the judicial system,other countries commutation system in China exist some disadvantages also gradually revealed,such as not being more specific regulations,proceedings is not clear,the participation of the victim can not get security and amplitude has disadvantages of commutation limit and commutation,etc.,thus affecting the realization of the function of punishment and violated the legitimate rights and interests of the criminal.Study based on the former research on commutation system,this paper introduces the connotation of the commutation system simple and existing significance,through comparing the commutation system of several countries abroad,analyses the commutation system in China,put forward the our country some problems in the current commutation system,and put forward the perfect Suggestions according to the problems one by one.
