| With the popularization of mobile communication network technology,the implementation of speed and fee reduction,the online network space is gradually integrated with the offline world.Nowadays,almost every one of us has multiple accounts on various online social networking platforms,which have penetrated into every aspect of our lives and recorded every detail of our lives.Therefore,social-media accounts not only have a large amount of property value,but also contain rich personality interests.However,in sharp contrast to the eternal network world,human beings have limited life.When life comes to an end,whether the social-media accounts we left behind can be inherited has undoubtedly become a real problem that needs to be solved urgently.In practice,due to the lack of systematic legal provisions related to virtual property,including social network accounts,people’s understanding of the basic connotation of social-media accounts,such as legal properties,is biased,which also leads to the doubt that social-media accounts can be inherited.In addition,the possible conflicts between the inheritance of social-media accounts and the rights and interests of network users,operators and communication third parties are the real obstacles to the inheritance of social-media accounts.In order to solve the inheritance problem of social-media accounts,this paper starts from the concept of social-media accounts,and generally sorts out the basic connotation and different types of social-media accounts.On this basis,through the analysis of the legal attributes of existing social-media accounts,it is proposed to divide social-media accounts into two parts: content and carrier.Secondly,based on the three elements of inheritance stipulated in the inheritance law and the civil code(draft),this paper demonstrates that the main value of social-media accounts is created by users and is the personal legal property of users rather than operators.Therefore,social-media accounts can become the heritage of users.In addition,this paper points out that although social-media account is filled with a lot of information about users and the interests of a third person personality data,but the inheritance to the account will not damage the their interests,it is effective measures to protect its interests.Finally,this paper roughly envisage the inheritance mode of social-media account,puts forward the inheritance mode to ensure that resources are not wasted,respect users’ realwishes and coordinate the legitimate interests of all parties as the guidance,and puts forward specific suggestions on the process of inheritance. |
