Artificial intelligence is a concept first proposed by Turing in 1950.He defined the intelligence that can distinguish human and computer as artificial intelligence.At present,artificial intelligence has three branches: weak artificial intelligence,strong artificial intelligence and super artificial intelligence.Artificial intelligence works by simulating the way the human brain works.It is based on networks of interconnected units that learn by modifying the connections between neurons.Artificial intelligence understands the world by building algorithms and models,which also mimics the human body structure,called convolutional neural network,or CNN.The development of artificial intelligence has gone through many stages.At first,the research of artificial intelligence mainly focuses on logic reasoning.However,the disadvantages of this use gradually show.Later,the research of artificial intelligence turned to probability reasoning.This transformation has made an important breakthrough in the field of learning,and AI has begun to enter the public life.After entering the 21 st century,artificial intelligence presents multiple development patterns,and has made a significant breakthrough in the application mode of causal reasoning.At present,artificial intelligence has been developing in many directions,such as large-scale distributed.To be a criminal subject,we need to have the ability of control and identification,the ability of punishment and the basic attributes of human beings.At present,the reason why AI can make behavior is that after the designer input the algorithm into AI,the latter will execute according to the algorithm.Artificial intelligence can not be separated from the tool attribute,and its behavior is not controlled by its own will,so it does not have the ability of control and discrimination.Secondly,because the behavior of AI is not controlled by its own will,but only "tool",so AI has no subjective malice.Therefore,its behavior does not meet the requirements of crime and does not constitute a crime.Third,artificial intelligence does not have human attributes.Unit can be the main body because it is the will of human behind,but artificial intelligence does not have this attribute.Therefore,at this stage,artificial intelligence is not the subject of criminal responsibility.In the future,artificial intelligence will have the ability of thinking,which will produce the ability of control and identification.Moreover,artificial intelligence can produce painful feelings,which makes it meet the basic requirements of becoming the subject of criminal responsibility,and artificial intelligence can become the subject of criminal responsibility.
