With the rapid development of science and technology,artificial intelligence has gradually into our life and became an inseparable part.However,the development of new things is always a double-edged sword,so is artificial intelligence,which brings us a lot of new legal problems and potential risks while bringing great convenience to our life,Many criminals take this opportunity to commit high-tech crimes,The field causing legal problems gradually develops from the civil field to the criminal field.Therefore,how to regulate and prevent artificial intelligence crime has become a hot topic in the criminal law circle.The premise of regulating and preventing artificial intelligence crime is to determine whether it has the qualification of criminal responsibility subject.Based on the case,this paper points out some difficulties of artificial intelligence in criminal law regulation.Through the analysis of the theory on the subject of criminal responsibility of artificial intelligence,the theoretical circle has a basically clear view on whether weak artificial intelligence can become the subject of criminal responsibility,that is,weak artificial intelligence can not become the subject of criminal responsibility,The criminal responsibility of the person behind him should be investigated.However,the strong artificial intelligence is always full of controversy.It is the so-called one thousand Hamlets in one thousand people's eyes.The strong artificial intelligence is divided into positive and negative views.It affirms that when artificial intelligence develops to a certain extent and breaks through the so-called singularity,it can produce the consciousness of independence,so it can bear criminal responsibility;The negative theory holds that artificial intelligence does not have the consciousness of independence,but implements legal acts through well written procedures.Even if it causes some damage consequences,it does not have the imputability of criminal law.For weak artificial intelligence,when a few criminals commit crimes through artificial intelligence,we can directly investigate the criminal responsibility of these criminals for intentional crimes;When weak artificial intelligence causes damage to others in the process of use,we should check whether it is due to design defects,substandard manufacturing process or improper operation,so as to punish the relevant human beings and bear the responsibility for negligence.After the coming of strong artificial intelligence era in the future,we can give artificial intelligence the qualification of criminal responsibility subject through legislation.When it commits a crime,we can take measures such as deleting data,modifying procedures,permanent destruction and so on.
