| With the development of the economy,the phenomenon of non-marital cohabitation has shown an increasing trend in China.Especially in recent years,non-marriage cohabitation has developed into a very common way of life in modern society.Whether it is from urban white-collar workers to mobile workers,or college students to widowed elderly,cohabitation is a common occurrence,and even regarded as a "trend." Even a marriage relationship protected by law will inevitably produce all kinds of contradictions.Such a“ trend”non-marital cohabitation relationship is more likely to cause disputes,and these disputes may have a greater impact on society.Among disputes caused by non-marital cohabitation,property disputes account for the vast majority.This article analyzes the specific operation of property disputes in non-marital cohabitation cases to clarify the thorny problems in the handling of non-marital cohabitation property,and proposes corresponding solutions for the reference of relevant departments.In addition to the introduction and conclusion,the full text includes three parts:The first part is about the basic theory of non-marital cohabitation and its property relationship.First,it introduces the concept and characteristics of non-marital cohabitation and the justification of other similar concepts.Secondly,the concept and types of non-marital cohabitation property relations are introduced,and the scope of non-marital cohabitation property relations is defined.Finally,the difference between non-marital cohabitation property relationship,marriage property relationship and partnership property relationship is analyzed to further clarify the scope of this article.The second part is about the concrete manifestation of disputes over non-marital cohabitation property relations in China.The author firstly selects the cases based on the analysis of disputes over cohabitation relationship in the judicial case database of the magic weapon,and selects the representative cases for specific analysis to introduce the current situation of property dispute cases in the relationship of non-marital cohabitation.Through the analysis of the case,it summarizes five common types of disputes involving property.Then take these five types of cases as examples,and carry out an analysis to discover the existing problems.The third part is about the legal response to non-marital cohabitation property disputes.This part is based on the problems raised in the second part,based on the reference to the relevant foreign systems and the specific national conditions of our country.Put forward targeted suggestions to help relevant departments learn from when handling such disputes. |
