| Trust system originated in Britain,with the continuous development of economy and social progress,it has been developing rapidly in the world,and public trust,as an important part of it,has been the hotspot of development in recent years.At present,China’s public trust has developed to a certain extent,but it is still in the embryonic stage,compared with the Western developed countries lag in development,there are problems of imperfect legal system,unclear regulatory agencies,imperfect supporting system.Therefore,it is necessary to study the difficulties and problems faced by the legal system of public trust in China,on the basis of mastering and understanding the actual situation of the development of public trust in China,and learning from the experience of trust development in developed countries,combining the domestic actual situation with the international development experience,the government and the society are urged to further improve the laws,regulations and implementation rules of the public trust,so as to realize the increasing scale,influence and credibility of the public trust.The full text consists of five parts.Part I: Introduction.This paper mainly expounds the background,significance,domestic and foreign research status of the relevant public trust,as well as the content and research methods of this paper.The second part: The theoretical basis of public trust and its development status in China.This paper expounds the theoretical basis of the public trust from the aspects of its legal principle and characteristics,and analyzes the present situation of the development of the public trust in our country and some typical cases This paper discusses the present situation of the legal system of public trust in China.The third part: Our Country Public Welfare Trust Legal System existence question and the reason analysis.The existing problems and their causes are analyzed.The fourth part:Overseas Public Trust Legal System Reference and reference.This paper focuses on the analysis of the common law countries and civil law countries(regions)in the legal system of public trust,as well as its advanced experience for China’s reference and inspiration.The fifth part: The suggestion and countermeasure of perfecting our country public welfare trust legal system.According to the actual situation in China,this paper puts forward some opinions and suggestions on how to improve the legalsystem of public trust in China from the aspects of dealing well with the existing legal relations,perfecting legislation,implementing the tax preferential system,perfecting supervision,etc.The conclusion expresses the expectation of the vigorous development of public trust in China. |
